No Charges Filed In Case Of Patient Left To Die In ER

UPDATED: 1:41 pm PDT July 8, 2008

Los Angeles County prosecutors will not file criminal charges against any medical or nursing staff at Martin Luther King-Harbor Hospital in connection with the May 2007 death of a woman who was ignored as she screamed in pain on an emergency room floor.

In a 12-page written report, a prosecutor from the District Attorney's Office wrote that there was insufficient evidence to file any charges against anyone at the hospital, including a triage nurse.

The woman's case generated three lawsuits against Los Angeles County.

The surveillance video was recorded on May 9, 2007. It shows employees, including a custodian with a mop, ignoring Edith Rodriguez as she writhes in pain on the floor.

Rodriguez died about 45 minutes later.

The video was posted on the Los Angeles Times Web site. Staff members said they do not know who provided the video to the Web site.

The Web site reported that excerpts of the video were sent anonymously last week to the newspaper.

The woman's death was among a series of events that led to the hospital's closure.

The video was posted one day after the release of video from a surveillance camera at a Brooklyn, N.Y. emergency room. The video shows a woman dying alone on the floor of the psychiatric hospital ER.
